Terms of Service
Welcome to briefly.family. These Terms of Service (the “Terms”) form a binding agreement between you and Briefly Family Inc. (“briefly.family,” “we,” “us,” or “our”). They govern your access to and use of our website, bots, applications, and related services (collectively, the “Service”). Please read them carefully—they describe how we work together to manage your family logistics, and they include important limitations on our liability and responsibilities you agree to take on.
1. Acceptance of Terms
By accessing or using briefly.family, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not use the Service. If you are using the Service on behalf of a household or family group, you represent that you are authorized to accept these Terms on their behalf.
2. Description of Service
briefly.family is an AI-powered assistant that helps parents and caregivers organize their family’s schedule. The Service interprets unstructured inputs — such as messages, school newsletters, screenshots, and PDFs — and attempts to extract dates, times, tasks, and related details into structured calendars and task lists. The Service is a productivity aid and convenience tool; it is not a substitute for your own judgment or record-keeping.
3. “As-Is” Service & Accuracy Disclaimer
Because the Service relies on artificial intelligence to interpret unstructured user inputs, it is provided strictly on an “as-is” and “as-available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
AI models can and do make errors, omissions, and “hallucinations.” They may misread a date, transpose a time, miss an event entirely, invent details that were never in your source material, or misclassify which child or family member an item belongs to. We make no guarantee that any extracted information is complete, accurate, current, or reliable.
You acknowledge and agree that you retain one hundred percent (100%) of the responsibility to review and manually verify the accuracy of all extracted calendar dates, times, tasks, and details against the original source before relying on them. You are solely responsible for any decision made, or action taken or not taken, in reliance on output from the Service.
4. Fees, Subscriptions & Billing
The Service is currently offered free of charge. We intend to introduce paid subscription plans in the future. When paid plans become available, we will publish the applicable fees, billing cycle, and renewal terms before you subscribe, and these Terms will continue to govern your use alongside any plan-specific terms you accept at checkout.
Where paid plans are offered on a recurring basis, they may renew automatically until cancelled, and we will disclose the renewal price and cancellation method at the point of purchase. All fees are stated in the currency shown at checkout and, unless stated otherwise or required by law, are non-refundable once a billing period has begun. We may change our fees on reasonable prior notice.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will briefly.family, its affiliates, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service — including, without limitation, a missed event, scheduling conflict, late arrival, or any other harm resulting from an AI error, omission, or inaccuracy.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to these Terms or the Service is capped at the greater of (a) the total amount you actually paid to briefly.family during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) zero dollars (S$0) if you are using a free tier of the Service. You acknowledge that the disclaimers and limitations in these Terms are a fundamental basis of the bargain between you and us, and that we would not be able to provide the Service on the current terms without them.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of Singapore. To the extent any statutory guarantee or condition cannot lawfully be excluded, our liability is limited, where permitted, to re-supplying the Service or paying the cost of having it re-supplied.
6. User Content, Warranties & License
“User Content” means any messages, communications, school newsletters, documents, PDFs, screenshots, images, and other materials you upload, forward, or otherwise submit to the Service. You retain ownership of your User Content.
You represent and warrant that you own, or have the explicit legal right and authority to submit, all User Content you provide — for example, that you are the parent, legal guardian, or an authorized representative of the family group the content concerns — and that your submission and our processing of it does not violate any law or the rights of any third party.
You grant briefly.family a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your User Content solely for the purpose of operating and providing the Service to you. This license exists only to let us perform the Service and ends when your User Content is deleted from our systems, except as required to comply with law.
7. Indemnification
You agree to indemnify, defend, and hold harmless briefly.family and its affiliates, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your breach of these Terms or of any warranty you make in them, including the content-ownership and authority warranties above; (c) your violation of any law or the rights of any third party; or (d) your misuse of the Service.
8. Acceptable Use
You agree to use the Service lawfully and respectfully. You must not:
- Reverse-engineer, decompile, or attempt to discover or replicate our prompt engineering, models, or underlying processing strategies.
- Scrape, crawl, harvest, or use automated means to access or extract data from the interface, except through functionality we expressly provide.
- Use the Service to process, store, or transmit unlawful, defamatory, harassing, abusive, infringing, or otherwise objectionable material.
- Probe, scan, overload, disrupt, or circumvent the security or rate limits of the Service, or otherwise abuse system resources.
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
9. Intellectual Property
The briefly.family platform — including its software, design, branding, and AI processing logic — is owned by Briefly Family Inc. and protected by intellectual property laws. Except for the limited rights expressly granted to you in these Terms, we reserve all rights in the Service. Your personal data and the User Content you submit remain yours.
10. Third-Party Services
The Service integrates with and depends on third-party services — for example, calendar providers (such as Google Calendar and Apple Calendar), messaging platforms, and AI infrastructure providers. We do not control these services and are not responsible for their availability, changes, errors, or acts or omissions. Your use of a third-party service may be governed by that provider’s own terms and privacy policy, and any such integration may be modified or discontinued at any time.
11. Termination of Service
We reserve the right, at our sole discretion, to suspend or terminate your access to the Service — with or without notice — if you violate these Terms, abuse system resources, or create risk or legal exposure for briefly.family or other users.
You may cancel your account and stop using the Service at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive — including the accuracy disclaimer, limitation of liability, content warranties, and intellectual property provisions — will survive termination.
12. Privacy & Data Security
Your privacy is paramount. Our collection and use of your data are governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement industry-standard security measures to protect your family’s information.
13. Governing Law & Dispute Resolution
In the event of any dispute, you agree to first contact us at [email protected] and attempt to resolve the matter informally before initiating any formal court proceedings.
These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Republic of Singapore. You and briefly.family agree to submit to the exclusive jurisdiction of the courts of Singapore, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
14. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and briefly.family regarding the Service.
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control.
- No Third-Party Rights: A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act of Singapore to enforce any of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date below and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
